Terms of Service for Moss Boss Atelier

 

This Terms of Service (“Agreement”) is a legally binding agreement between you (“User” or “you”) and Moss Boss Atelier (“we,” “us,” or “our”), governing your use of our website and the purchase of products from our e-commerce store.

1. Eligibility. By using our website and purchasing products from our store, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

2. Account Registration. You are not required to create an account to make a purchase from our store. However, if you choose to create an account, you agree to provide accurate and complete information and to keep your login credentials confidential.

3. Product Descriptions. We make every effort to accurately describe the products offered on our website. However, we do not warrant that product descriptions or other content on our website are error-free, complete, or current.

4. Payment and Billing. We accept all major credit cards, including PayPal, Google Pay, Shop Pay, and Meta Pay. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your purchase (including any applicable taxes and other charges).

5. Shipping and Delivery. We use USPS, UPS, FedEx, Pirate Ship, and I Ship to deliver our products. Our delivery times are between 4-6 weeks. If you need your order sooner, please contact us and we will do our best to accommodate your request. However, we do not guarantee delivery dates and are not liable for any delays in delivery.

6. Returns and Refunds. All sales are final and we do not accept returns. If you receive a damaged or defective product, please contact us within 7 days of receipt to request a replacement.

7. Warranty. We offer a 2-year craftsmanship warranty on the wood frame of our products. If the wood frame of your product fails due to a defect in materials or workmanship within 2 years from the date of purchase, we will repair or replace it at our discretion. This warranty does not cover the moss or any other components of the product.

8. Intellectual Property. All content on our website, including text, graphics, logos, images, and software, is the property of Moss Boss Atelier or its content suppliers and is protected by United States and international intellectual property laws. You may not use any content on our website for any commercial purpose without our prior written consent.

9. Disclaimers and Limitations of Liability. Our website and products are provided “as is” without warranty of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

In no event shall we be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your use of our website or products, whether or not we have been advised of the possibility of such damages.

10. Governing Law and Jurisdiction. This Agreement shall be governed by the laws of the State of California without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to this Agreement or your use of our website or products shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

11. Dispute Resolution. Any dispute arising out of or relating to this Agreement or your use of our website or products shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Los Angeles County, California.

12. Severability. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.

13. In the event of the artist's death, terminal illness, or unforeseen acts of nature, the completion of the job may be impeded or rendered impossible.
